We, the Berlin Tourism Marketing GmbH (BTM GmbH), conduct a mail order business via our Online Souvenir Shop. Our general terms and conditions are valid for all of our offers, deliveries, and services. They are also valid for all future business dealings, without any further agreements. These terms and conditions are considered to be accepted upon ordering, at the latest when the goods or services have been accepted. Any conditions of the purchaser, especially regarding the terms of purchase, are herewith contradicted. This means that they also will not be recognized even if we do not explicitly contradict the terms.

All prices (catalog prices) include sales tax. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including prices. The price given by the publisher at the time of delivery is valid for published products which are bound to retail price maintenance.

All deliveries within the Federal Republic of Germany will be charged with a flat shipping and handling fee of € 5.00. For all orders totalling over € 200.00 a flat fee of € 7.50 will be charged. All deliveries to other European countries will be charged with a flat shipping and handling fee of € 15.00.

Should you prefer to have your shipment sent by courier, you will be charged for all incurring costs of delivery.

1. All deliveries will be made to the address which you indicate. The customer is responsible for any damage that occurs during shipping and handling.

2. All information on estimated delivery times is without guarantee, unless a specific delivery date is given. Delivery, as well as any information on certain delivery deadlines, lies under the provision that we, ourselves, have received our deliveries correctly and punctually and are not responsible for the lack of availability of the products. We will inform you if a product is not available and will return any payments already made for undeliverable products. There will be no compensation for incurring damages, as long as there was no gross negligence on our part. In the case of gross negligence we will still not be held responsible for atypical contract damages or damages that are not easily forseeable. For cases of lesser negligence, we can only be held responsible for the violation or non-fulfillment of substantial contract obligations.

1. You as the consumer have the right to cancel your order within two weeks of delivery/receipt of the goods according to § 3 Para. 1 and Para.
2. FernAbsG, as long as you are an individual and the legal transaction can neither be ascribed to your commercial or self-employed activity. The cancellation must occur either in writing, via a long-term data carrier, or through the return of the goods within two weeks of receipt. The two-week cancellation period of time begins with the receipt of the goods, for recurring deliveries on the day of receipt of the first partial delivery, and for services on the day of the contract closing. There is no right to cancellation for delivery contracts

1. for the delivery of goods which were produced according to the specific specifications of the customer or which were unmistakably designed according to their personal needs or which due to their nature are not suitable to be returned or which are quickly perishable and their expiry date has passed,
2. for delivery of audio or video recordings or software when the seal of the data carrier has been broken by the consumer,
3. for delivery of newspapers, periodicals, or magazines.

If you are not a consumer, but a legal person or an individual for which the legal transaction can be ascribed to your commercial or self-employed activity, you only have the right to return within two weeks of delivery/receipt if the goods are damaged. If an assured quality of the goods is missing, compensation can be claimed, however, limited by the extent of the assurance and by the forseeable damages at the point of the contract closing.

Our invoices must be paid within ten days of receipt without discount. We have the right to add a late payment fee of € 5.11 with the second reminder. We have the right to add a late payment fee of € 11.23 with the third reminder. Following the third unsuccessful reminder, we will pass the case on to our collection agency. For orders on the internet you may also pay by credit card. Checks will only be accepted for fulfillment and are not considered payment until cashed.

All goods remain the property of the BTM GmbH until the full payment has been received.

1. Berlin is the place of fulfillment for all claims from the contract and is also the responsible court of law.

2. These terms and conditions as well as the complete legal relations resulting from the contract underlie exclusively the laws of the Federal Republic of Germany.

3. Should singular regulations be or become null and void, the remaining regulations remain valid. The respective null and void clause is to be replaced by an effective clause, that is to be as close as possible economically to the null and void clause.

Your name and address, as well as all other information required to complete the transaction, will be saved under the terms of the data protection law.
